Information on the BBE / BBD
In accordance with European Regulation No. 1169/2011 of 25 October 2011 on the provision of food information to consumers, certain categories of products are not subject to the obligation to display a Best Before Date, also known as BBE or former BBD.
This exemption applies in particular to confectionery products composed almost exclusively of flavoured and/or coloured sugars, as well as chewing gums and similar chewing products.
In France, Law No. 2015-992 of 17 August 2015 on the energy transition for green growth specifies that the inclusion of the BBD is prohibited on products covered by this exemption, in order to limit food waste when this date is not relevant.
Thus, for certain confectionery products, the absence of a BBE or BBD on the packaging is in compliance with current regulations.
*BBD (Best Before Date) or BBE (Best Before End) – Confectionery products do not have a use-by date (UBD) but a best before date (BBD or BBE). A reminder on the regulations: The best before date is an indicative date. Once the date has passed, the product may lose some of its taste or nutritional qualities (a reduction in vitamin content, for example), but is not harmful to health. A product may be offered for sale with an expired BBE. This does not constitute an infringement.
