Information on the date of minimum durability / BBD
Under European Regulation No 1169/2011 of 25 October 2011 on the provision of food information to consumers, certain categories of products are exempt from the requirement to display a date of minimum durability (DMD), also known as a best-before date or formerly as a BBD.
This exemption applies in particular to confectionery products consisting almost exclusively of flavoured and/or coloured sugars, as well as chewing gum and similar products for chewing.
In France, Law No 2015-992 of 17 August 2015 on the energy transition for green growth specifies that displaying a BBD is prohibited on products covered by this exemption, to limit food waste where the date is not relevant.
For certain confectionery products, the absence of a date of minimum durability or BBD on the packaging therefore complies with current regulations.
