Under European Regulation No 1169/2011 of 25 October 2011 on the provision of food information to consumers, certain categories of products are not required to display a best-before date, also known as the date of minimum durability (DDM) or formerly the BBD.
This exemption applies in particular to confectionery products consisting almost entirely of flavoured and/or coloured sugars, as well as chewing gum and similar products for chewing.
In France, Law No 2015-992 of 17 August 2015 on the energy transition for green growth even stipulates that displaying a BBD is prohibited on products covered by this exemption, to limit food waste when such a date is not relevant.
Therefore, for certain confectionery products, the absence of a DDM or BBD on the packaging complies with current regulations.
